By conducting thorough research into the provider's reputation and reading reviews from other buyers beforehand, you can effectively prevent many potential problems and fraudulent practices before you actually proceed to payment.

The Legal Right of Return and Cooling-Off Period

One of the most important pillars of consumer protection by law is the right to a cooling-off period. When you as a consumer buy a product online, you have a legal right to a minimum of fourteen calendar days to dissolve the purchase agreement without giving any reason, a right often referred to as the right of withdrawal. This period starts on the day after you receive the product. During this period, you may assess and try out the product at home just as you would in a physical store.

Should you decide to return the purchase, you must notify the seller in writing or via a model form within these fourteen days. After this notification, you have another fourteen days to actually return the product. The seller is then obliged to refund the full purchase amount, including any standard shipping costs for delivery, within fourteen days of the cancellation notice.

Please note that the direct costs for the return shipment are usually at your own expense, unless the seller has indicated otherwise.

Canceling a Placed Order

It can happen that you regret making an online purchase immediately after placing it, or that the delivery time turns out to be unexpectedly long. In such cases, you may wish to cancel the placed order immediately. As long as the product has not yet been shipped, you can make a free claim on your right to cancel the order under the same rules as the right of withdrawal.

However, it is important to know that not all products qualify for this right. Exceptions to the return right and the right of cancellation include goods specifically custom-made for you, products that can spoil quickly, and sealed items that are not suitable for return for reasons of health protection or hygiene once the seal has been broken. If your purchase falls under one of these exceptions, you are in principle bound to the purchase.

If there is a valid cancellation, the webshop must credit the payment as soon as possible, so that you do not have to wait unnecessarily long for your money.

Rights in Disputes and Delivery Issues

Should a dispute unexpectedly arise between you and the online seller, for example about a delayed delivery or a refused return shipment, you are not alone in the Netherlands. The Authority for Consumers and Markets (ACM) strictly monitors compliance with consumer rules by companies. If an online store does not comply with the legal rules, you can file an official report with ConsuWijzer.

In addition, many Dutch webshops are affiliated with an independent disputes committee, which can make binding decisions in conflicts between consumers and entrepreneurs. This offers a low-barrier and inexpensive alternative to going to court. It is advisable to always record communication with customer service in writing, so that you have tangible evidence should the situation escalate.
